§ 1 Information on the collection of personal data

(1)  In the following, we inform about the collection of personal data when using our website. Personal data are all data that can be related to you personally, e.g. name, address, email addresses, user behavior.

(2)  The responsible party according to Art. 4 Para. 7 EU Data Protection Basic Regulation (DS-GVO) is the company PromaMedical GmbH, Wernher-von-Braun-Straße 10, 85640 Putznrunn - Munich, Germany (see our imprint).

(3)  When you contact us by email or through a contact form, the data you provide (your email address, your name, and possibly your telephone number) will be stored by us to answer your questions. We delete the data arising in this context after storage is no longer necessary, or limit processing if there are legal storage obligations.

§ 2 Your rights

(1)  You have the following rights regarding your personal data:

  • Right to information, - Right to correction or deletion, - Right to restrict processing, - Right to object to processing, - Right to data transferability.

(2)  You also have the right to complain to a data protection supervisory authority about the processing of your personal data by us.

§ 3 Collection of personal data when visiting our website

(1)  In case of purely informational use of the website, i.e. if you do not register or otherwise transmit information to us, we only collect the personal data that your browser transmits to our server. If you want to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security (legal basis is Art. 6 Para. 1 S. 1 lit. f DS-GVO):

  • IP address, - Date and time of the request, - Time zone difference to Greenwich Mean Time (GMT), - Content of the request (specific page), - Access status/http status code, - The amount of data transferred each time, - Website from which the request comes, - Browser, - Operating system and its interface, - Language and version of the browser software

(2)  In addition to the above-mentioned data, cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard drive assigned to the browser you are using and by which the body that sets the cookie (here by us) receives certain information. Cookies cannot run programs or transmit viruses to your computer. They serve to make the internet offer more user-friendly and effective.

You can configure your browser settings according to your wishes and e.g. reject the acceptance of cookies. We would like to point out that you may not be able to use all functions of this website.

§ 4 Ordering process and user account

(1)  In addition to the purely informational use of our website, we offer you the possibility to place orders via an individual, password-protected customer account. The customer account includes an overview of orders placed and active ordering processes. When a customer leaves the online shop, they are automatically logged out.

The website operator assumes no liability for password misuse, unless this misuse was caused by the website operator himself.

(2)  The following personal data is stored during the order process:

  • Name, First name, - Address, - E-mail address, - Payment data.

The data necessary for order processing and delivery are passed on to third-party service providers. As far as the storage of your data is no longer necessary or legally required, these will be deleted. Without your consent, these data will not be passed on to third parties.

§ 5 Handling of comments and contributions

If you leave a post or comment on this website, your IP address will be saved. This serves the security of the website operator. If your text violates the applicable law, your identity can be traced.

§ 6 Subscriptions

You have the opportunity to subscribe to the entire website as well as follow-up comments on your post. You will receive an email to confirm your email address. No other data is collected. The stored data will not be passed on to third parties. You can unsubscribe from a subscription at any time.

§ 7 Objection or revocation against the processing of your data

(1)  If you have given your consent to the processing of your data, you can revoke this at any time. Such a revocation affects the permissibility of processing your personal data after you have pronounced it to us.

(2)  As far as we base the processing of your personal data on the balance of interests, you can object to the processing. This is the case if the processing is not necessary in particular to fulfill a contract with you. When exercising such an objection, we ask for an explanation of why we should not process your personal data as we have done. In the case of your justified objection, we will examine the situation and either stop or adjust the data processing or point out our compelling reasons worthy of protection on the basis of which we continue the processing.

§ 8 Use of Google Analytics

(1)  This website uses Google Analytics, a web analytics service provided by Google Inc. ("Google"). Google Analytics uses so-called "cookies", text files that are stored on your computer and that allow an analysis of your use of the website. The information generated by the cookie about your use of this website is usually transmitted to a Google server in the USA and stored there. In the event of activation of IP anonymization on this website, your IP address will be truncated by Google within member states of the European Union or in other contracting states of the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and truncated there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide other services related to website activity and internet usage to the website operator.

(2)  The IP address transmitted by your browser as part of Google Analytics will not be merged with other Google data.

(3)  You can prevent the storage of cookies by setting your browser software accordingly; however, we would like to point out that in this case you may not be able to use all functions of this website to their full extent. You can also prevent the collection of data generated by the cookie and related to your use of the website (including your IP address) to Google and the processing of this data by Google by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de .

(4)  We use Google Analytics to analyze the use of our website and to improve it regularly. We can improve our offer and make it more interesting for you as a user through the statistics we have obtained. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield, https//www.privacy-shield.gov/EU-US-Framework. The legal basis for the use of Google Analytics is Art. 6 Para. 1 S. 1 lit. f DS-GVO.

§ 9 Use of social media plugins

(1)  We currently use the following social media plugins: Facebook, Google+, Twitter.

(2)  The social media plugin from Facebook can be recognized by the Facebook logo or by the terms "Like", "Like", "Share" in the colors of Facebook (blue and white). Information on all Facebook plugins can be found at the following link: https://developers.facebook.com/docs/plugins/ .

(3)  The social media plugin from Google+ can be recognized by the "+1" button. Information on the "+1" button can be found at the following link: https://developers.google.com/+/web/buttons-policy .

(4)  The social media plugin from Twitter can be recognized by the Twitter buttons. Information on the Twitter buttons can be found at the following link: https://twitter.com/privacy?lang=de .

(5)  The social media plugin from Facebook establishes a direct connection between your browser and the Facebook servers. When visiting a page with the "+1" button from Google+ or the Twitter buttons, a direct connection is established between your browser and the Google servers or the Twitter servers. In any case, the data mentioned in § 3 of this declaration are transmitted.

We have no influence on the data collected and data processing processes, nor are we aware of the full extent of data collection, the purposes of processing, the storage periods. We also have no information on the deletion of the collected data by the plugin providers.

(6)  The plugin providers store the data collected about you as usage profiles and use these for purposes of advertising, market research and demand-oriented design of their websites. Such an evaluation takes place in particular (also for not logged in users) for the presentation of demand-oriented advertising and to inform other users of the social network about your activities on our website. You have a right to object to the creation of these user profiles, whereby you must contact the respective plugin provider to exercise this right. Through the plugins, we offer you the opportunity to interact with social networks and other users, so that we can improve our offer and make it more interesting for you as a user.

The legal basis for the use of the plugins is Art. 6 Para. 1 S. 1 lit. f DS-GVO.

(7)  The data transfer takes place regardless of whether you have an account with the respective plugin provider and are logged in there. If you are logged in with the respective plugin provider, your data collected by us will be directly assigned to your existing account with the respective plugin provider. The respective plugin provider also stores this information in their respective user account and shares this information publicly with your contacts. We recommend that you regularly log out after using a social network, as this can avoid an assignment to your profile with the respective plugin provider.

(8)  Further information on the purpose and scope of data collection and its processing by the plugin provider can be found in the data protection declarations of these providers communicated below. There you will also find further information on your rights in this regard and setting options for protecting your privacy.
